Cancellations, refunds and deferments

The cancellation and refund policy applies to all courses and online learning products. This policy is stated here, on the course information pages and in PDF documents supplied via email after course bookings are made.

Terms of interest-free payment plans

These are the terms you will agree to when using a subscription-based payment plan to pay course fees, for which monthly instalments are taken from your bank account over a period of 3, 6 or 12 consecutive months.

These plans are open to UK and international students; UK students’ plans may run past the course dates and international students’ plans must be completed before the course starts.

Course payment plan Agreement: part 1

Plans where payments are completed before the start date of the course

This Agreement commences on the date of plan purchase and continues throughout the period of the plan you select.

The total cost of the course is shown on the course information page. The plan length and amount payable each month is shown when you select a plan on the course information page, in your shopping basket and in the booking confirmation email. You have a right to end this Agreement at any time by paying the amount outstanding under the Agreement at that time.

In the unlikely event that we wish to end the Agreement, we will inform you of this in writing with 7 days’ notice and refund all monies paid.

Course payment plan Agreement: part 2

Plans where payments are completed after the start date of the course

This Agreement commences on the date of plan purchase and continues throughout the period of the plan you select.

The total cost of the course is shown on the course information page. The plan length and amount payable each month is shown when you select a plan on the course information page, in your shopping basket and in the booking confirmation email. You will pay these instalments in their entirety to complete your purchase and participate on the course.

You have a right to end this Agreement at any time by paying the amount outstanding under the Agreement at that time.

Missing payments prior to the start of the course could result in you being unable to take the course. If you default on payments after having taken the course, we may charge you for any legal or other costs we incur in recovering the debt, including a fee for our reasonable administrative costs.

In the unlikely event that we wish to end the Agreement before the course commences we will inform you of this in writing with 7 days’ notice and refund all monies paid.

Consumer Credit Act

The Consumer Credit Act 1974 covers this Agreement and lays down certain requirements for your protection. If you would like to know more about your rights under the Act, contact either your local Trading Standards Department or your nearest Citizens’ Advice Bureau.

Payment plan defaults on all courses

If you are having difficulty meeting payments please contact us and discuss it; we can be accommodating if we are aware of your situation.

1st payment:

Non-refundable in all circumstances

Unpaid instalment with customer contact:

A new payment date can be arranged; if payment is then not received within 7-days of the new date all payments to date are non-refundable and cancellation of place actioned

Unpaid instalment without customer contact:

All payments to date are non-refundable and cancellation of place actioned

Cancellations, refund and deferments

If you wish to cancel your place, the standard cancellation, refund and deferment policies apply to places purchased using payment plans. These appear here, on the course information page and in the FAQs, and are also in the document emailed to you after booking.

Your Agreement

Please ensure you read the above terms and below statement carefully before proceeding

By checking the box labelled I HAVE READ AND AGREE TO NEILL GORTON PROSTHETICS STUDIO’S TERMS AND CONDITIONS on the purchase page of the payment plan, you are agreeing to the above terms that relate to the dates of the course you are booking; part 1 or part 2 as applicable and part 3 in all circumstances.

Terms and conditions of attending courses

Please abide by the following rules to ensure an enjoyable and safe experience for everyone:

  • You must be over 18 (apart from when otherwise specified), have a good understanding of spoken English and basic conversational use of English
  • You must have read the course information, curriculum and self-assessment entry criteria on the course information page to ensure the course you are doing is suitable for you
  • All studio health and safety procedures must be strictly adhered to. Gorton Studio reserves the right to ask any student not following the guidelines to leave the course. Refunds will not be granted in this instance
  • Please ensure all working areas are cleaned and materials put away at the end of each day
  • Please do not smoke inside the studio or Millennium FX workshop
  • Please don’t eat in the studio or Millennium FX workshop
  • Photos/videos we take during the course will be used for future marketing purposes
  • Every student is expected to behave respectfully and courteously to their fellow students and the staff. Anyone behaving in an antisocial, inflammatory, antagonistic or inappropriate manner may be asked to leave the course. Refunds will not be granted in this instance
  • The Gorton Studio classroom is situated in the Millennium FX building. Please don’t enter the Millennium workshop without permission; Millennium is a busy industry FX company and we expect students to respect this fact and act responsibly and considerately within it, and in all the communal areas inside and outside the building. Anyone failing to respect the environment, the staff, our guests or disrupting the business of Millennium FX in any way may be asked to leave the course. Refunds will not be granted in this instance
  • Please sign the non-disclosure/health & safety/media policy agreement provided on day one before your course begins
  • Please sign in and out of the building every day

Purchases

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999. If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Neill Gorton Prosthetics Studio is not responsible for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Neill Gorton Prosthetics Studio cannot accept any liability for loss or damage arising out of such cancellation.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Availability, errors and inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Section “Availability, Errors and Inaccuracies” is without prejudice to existing statutory rights.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). Subscription is the payment type used for the repeat payments made on our interest-free payment plans or online learning access. You will be billed on a recurring and periodic basis (“Billing Cycle”) for the duration of your subscription (the duration of your chosen payment plan) or on an ongoing basis for continual online learning subscriptions. Billing cycles are set on either a monthly or annual basis for our payment plan and online learning products.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions for continual subscriptions or until you complete all the payments in your chosen payment plan, unless you cancel it or Neill Gorton Prosthetics Studio cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Neill Gorton Prosthetics Studio customer support staff. Cancellation terms apply to course payment plans as stated in the cancellation, refund and deferment policy in this document and on the course information page and FAQs page on this website.

A valid payment method, including credit or debit card, is required to process the payment for your Subscription. You shall provide Neill Gorton Prosthetics Studio with accurate and complete billing information including full name, address, county/state, post/zip code, telephone number, and a valid payment method. By submitting such payment information, you automatically authorise Neill Gorton Prosthetics Studio to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing for course payment plans fail to occur for any reason, Neill Gorton Prosthetics Studio will contact you to rearrange the payment which you must make within 7-days of the new date, otherwise all payments to date are non-refundable and cancellation of your place will be actioned. If you do not communicate with Neill Gorton Prosthetics Studio about the failed automatic billing for a course payment plan, all payments you have made to date are non-refundable and cancellation of your place will be actioned.

Fee changes for online leaning subscriptions

Neil Gorton Prosthetics Studio, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions to online learning products. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Neill Gorton Prosthetics Studio will provide you with a reasonable prior notice of any change in Subscription fees for online learning products to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service for online learning after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds for online learning subscriptions

Except when required by law, paid Subscription fees are non-refundable.

Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene. You expressly agree that we cannot be held liable for any loss or damage arising out of any misrepresentations you make in this regard.

Our Service may contain links to third- party websites or services that are not owned or controlled by Neill Gorton Prosthetics Studio. Neill Gorton Prosthetics Studio has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. The Service and its original content, features and functionality are and will remain the exclusive property of Neill Gorton Prosthetics Studio and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Neill Gorton Prosthetics Studio.

Copyright notice for Learn Online content

This copyrighted work has been licensed for private use only and any other use of the whole or any part of the material (including adapting, copying, issuing copies, unauthorised lending, public performance, broadcasting or making the same available via the internet or wireless technology or authorising any of the foregoing) is strictly prohibited.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Neill Gorton Prosthetics Studio and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

Limitation of liability

In no event shall Neill Gorton Prosthetics Studio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
